Insurance and Safety Fire Commissioner John F. King has announced charges against two men from Walton County, Georgia, in connection with an alleged insurance fraud scheme. Frank Brake III of Lithonia and Terry McMillian Jr. of Monroe, both 32 years old, face charges of Insurance Fraud and Theft by Deception.

The case dates back to February 14, 2023, when the suspects secured a $100,000 auto loan for a 2021 Jeep Track Hawk. By July of the same year, they reportedly conspired to falsely report the vehicle as stolen.

Commissioner King stated, “Upon investigation, our agents determined the vehicle was never in possession of either suspect.” He further explained that the men aimed to “receive additional funds as reimbursement from their insurance company for a loss that never truly occurred.”

Following these findings, warrants were issued on March 12, 2025. Brake was arrested on March 20, while McMillian surrendered to authorities on March 24. Both have since been released on bond.

The investigation is being conducted in collaboration with the Walton County Sheriff’s Office.

The Office of Commissioner of Insurance and Safety Fire is committed to protecting Georgia families by ensuring access to essential insurance products and safe buildings through equitable regulation.
