Colorado Division of Insurance seeks comments on flood response; adopts wildfire damage bulletin

The Colorado Division of Insurance is seeking public feedback on a draft bulletin addressing insurer practices following the 2025 floods in southwestern Colorado, including Pagosa Springs and other areas in the southern part of the state. The Division has asked insurers to consider specific guidance when communicating with policyholders, regardless of whether they hold flood insurance.

Comments on the draft proposed new bulletin must be submitted by 5 PM on October 27, 2025, via email to DORA_INS_RulesandRecords@state.co.us. The draft and other regulations currently open for informal public comment are available on the Division's DRAFT Regulations and Bulletins for Informal Public Comment website.

In addition to this request for comment, the Division announced that Commissioner Michael Conway has adopted Bulletin B-5.53. According to the Division, "The purpose of this bulletin is to inform property and casualty insurers issuing residential property policies in Colorado of the Division’s position regarding sub-limits for wildfire smoke, soot, ash, odor, and char damage."

The new bulletin takes effect as of October 20, 2025. It can be found along with other bulletins on the Division's official website.
