Georgia insurance commissioner schedules hearing on new rule amendments

The Georgia Office of Insurance and Safety Fire Commissioner has announced a public hearing on proposed amendments to its rules and regulations. The hearing was scheduled for September 10, 2025, at 10:00 a.m. in the Hearing Room of the Office of Commissioner of Insurance, located on the Ninth Floor, West Tower, Floyd Building, Two Martin Luther King, Jr. Drive, Atlanta.

Proposed changes include amending Rule 120-2-3-.05 to eliminate requirements for branch offices of agencies following the passage of House Bill 410. Rule 120-2-3-.48 will be amended to certify Georgia Access Specialists through the Georgia Access Division and remove Sircon references for registration.

Further amendments involve Rule 120-2-112-.03 to define terms related to health plans and clarify existing definitions. Rule 120-2-112-.04 will clarify its applicability to Qualified Health Plans (QHP) and Stand-Alone Dental Plans (SADPs). Amendments to Rule 120-2-112-.06 aim to align Special Enrollment Periods with federal regulations under 45 C.F.R. § 155.420.

New rules are being introduced as well. Rule 120-2-112-.09 proposes establishing a Small Business Health Options Program. Rules 120-2-112-.10 and .11 outline requirements for consumer applications, plan renewals, eligibility for health plans, and financial assistance. Rule 120-2-112-.12 addresses consumer appeal processes for adverse enrollment determinations.

The proposals are available at the Administrative Procedure Division office in Atlanta and are open for public comment until September 3rd, 2025. Comments can be submitted in writing or orally during the hearing. Jeremy Betts from the Administrative Procedure Division is handling correspondence regarding these proposals.

"Based upon full consideration of all written and oral comments regarding the above matters," states the notice, "the Commissioner of Insurance may reject or adopt the proposed rules or may make changes to the proposed rules which may require another rulemaking hearing."
