Colorado Division of Insurance seeks input on new reporting rules for insurers using consumer data

The Colorado Division of Insurance is inviting public feedback on a draft bulletin that aims to clarify reporting requirements for private passenger auto and health insurers using external consumer data and information sources (ECDIS). The proposed guidance responds to questions from insurers about how to prepare interim progress reports as mandated by Colorado Insurance Regulation 10-1-1.

According to the Division, “The Division has received inquiries from insurers requesting guidance regarding the manner and format of the interim progress report required by Colorado Insurance Regulation 10-1-1 for private passenger auto and health insurers that use external consumer data and information sources (ECDIS), or algorithms or predictive models that use ECDIS, in any insurance practice, as specified in Colorado Insurance Regulation 10-1-1. The purpose of this bulletin is to provide the requested guidance.”

Comments on the draft must be submitted by 5 PM on November 12, 2025, via email at DORA_INS_RulesandRecords@state.co.us. The draft bulletin and other regulations open for informal comment are available on the Division’s DRAFT Regulations and Bulletins for Informal Public Comment website.
