The Cambo Ferry Law Firm has publicly rejected House Bill (HB) 1551, cautioning that the bill’s prevailing party language could be exploited and destabilize Florida’s property insurance system. This announcement was made in a White Paper released on March 19.

According to the Cambo Ferry Law Firm, HB 1551 introduces unclear legal standards that could significantly disrupt current litigation processes in Florida’s insurance sector. The firm warns that the legislation lacks critical definitions for determining good faith settlement offers and prevailing party status. This legal uncertainty, they argue, will foster inconsistent judicial interpretations and undermine predictability for insurers and policyholders alike.

The White Paper states, “HB 1551 is completely ambiguous, which will lead to multiple lawsuits up to the Florida Supreme Court to determine the legislative intent and scope of the proposed statute.” The firm emphasized that without defined terms or thresholds, both trial and appellate courts would be burdened with interpreting the statute through case law. This could take years and generate significant legal costs, further straining an already fragile property insurance system.

Data from the Florida Office of Insurance Regulation indicates that the state’s property insurance market has begun to stabilize following reforms passed in 2022. Citizens Property Insurance Corporation reported a 50% drop in new litigation. Legal reforms, including the elimination of one-way attorney fees, were designed to reduce frivolous lawsuits and insurer insolvencies. Ferry warns that HB 1551 risks undoing this progress by opening the door to increased legal ambiguity.
