The American Tort Reform Association (ATRA) has issued a warning in a press release about a potential rise in litigation under the leadership of trial lawyer Robert F. Kennedy Jr.

The “Make America Healthy Again” (MAHA) report, led by Health Secretary Kennedy and commissioned by President Trump, attributes the increase in childhood chronic diseases to factors such as ultra-processed foods, environmental toxins, and overmedicalization. The report has faced criticism for its scientific inaccuracies and for echoing anti-vaccine rhetoric, raising concerns among medical experts and industry groups. According to The Washington Post, the report’s claims have been challenged for misinterpreting scientific research and failing to address structural issues in healthcare.

The MAHA report identifies ultra-processed foods, environmental chemicals like glyphosate and atrazine, and the overprescription of medications as key contributors to chronic illnesses among American children. It highlights alarming trends such as a 1,400% increase in teenage antidepressant prescriptions since 1987 and the presence of over 40,000 chemicals in children’s environments. The Times reports that the commission’s findings have drawn both praise and criticism, with some industry groups expressing concern over the report’s implications.

Kennedy’s ties to the legal industry include past employment with Morgan & Morgan and ongoing co-counsel roles with Wisner Baum, a firm involved in litigation related to glyphosate and talc. He has transferred his financial interests in vaccine litigation to his son, who is an attorney at Wisner Baum. According to STAT News, Kennedy earned $856,559 in referral fees from Wisner Baum in 2023, raising questions about potential conflicts of interest.
